CITY OF DEQUINCY
ORDINANCE NO. 923
The City Council of the City of DeQuincy, State of Louisiana, met in regular session on the 18th day of May 2020, and adopted the following Ordinance as an amendment to the General Zoning Ordinance.
WHEREAS, the City of DeQuincy desires to update and modernize its Code of Ordinances regarding the regulation of mobile homes.
THEREFORE, BE IT ORDAINED by the City Council that Section 6(a)(1) section of Appendix A: General Zoning Ordinance is hereby amended to read as follows:
Section 6(a)(1) Any structure not built on site and intended for use as a residence including but not limited to mobile home, house trailer, modular home, tiny home, portable building, and dwelling that is in compliance with U.S Department of Housing and Urban Development Quality Housing Standards (Section 8) that are mounted on a metal chassis or may be moved on existing or attachable axles or wheels.
BE IT ORDAINED by the City Council that Section 6(a)(2) of Appendix A – General Zoning of the Code of Ordinances of the City of DeQuincy is hereby enacted to read as follows:
Section 6(a)(2) : Districts 1, 2, 3, and 4 can only issue 3 more permits for mobile homes per District after the effective date of this amendment. Henceforth, that will be the allowable maximum number of mobile homes for that District. If one or more mobile homes are removed from a District, then the District will be allowed to add a replacement mobile home or homes to cover each loss.
BE IT ORDAINED by the City Council that Section 6 (a)(3) of Appendix A – General Zoning of the Code of Ordinances of DeQuincy is hereby enacted to read as follows:
Section 6 (a)(3): Each owner or owners of a mobile is hereby required to register their mobile with the City of DeQuincy and pay a yearly fee of $20.00, commencing with the initial registration thereof, which registration must occur within sixty (60) days of the effective date of this Ordinance.
BE IT ORDAINED by the City Council that Section 6 (a)(4) of Appendix A – General Zoning of the Code of Ordinances of DeQuincy is hereby enacted to read as follows:
Section 6(a)(4): No travel trailer or motor home can be used for a home or dwelling by any person or persons within the City of DeQuincy.
BE IT ORDAINED by the City Council that Section 6(a)(5) of Appendix A – General Zoning of the Code of ordinances of the City of DeQuincy is hereby enacted to read as follows:
Section 6(a)(5): No property in the City of DeQuincy can be used for the establishment of a mobile home park which is declared to be the placement of more than one mobile home on any tract of land irrespective of ownership or legal description.
THEREFORE, BE IT FURTHER ORDAINED by the City Council that Section 6(b)(3) of Appendix A: General Zoning Ordinance is hereby amended to read as follows:
Section 6(b)(3) The mobile home shall be placed on the property such that no part thereof is closer than fifteen (15) feet to a public street, road right-of-way, or property line.
THEREFORE, BE IT ORDAINED by the City Council that Section 6(b)(4) of Appendix A: General Zoning Ordinance is hereby amended to read as follows:
Section 6(b)(4) The minimum size for mobile homes or any building or structure classified as such in accordance with Section 6(a)(1) shall be 924 square feet of living space.
BE IT FURTHER ORDAINED by the City Council that should any section, clause, or provision of this ordinance be declared invalid by any court of competent jurisdiction, the same shall not affect the validity of the ordinance as a whole, or any part thereof, other than the part
or parts declared to be invalid. All ordinances or parts of ordinances in conflict with any of the provisions of this ordinance are hereby repealed.
All other sections, paragraphs, subsections, subparagraphs, clauses, phrases and words of Appendix A, not specifically amended by this ordinance, are to remain the same.
