CITY OF DEQUINCY
ORDINANCE NO. 940
The City Council of the City of DeQuincy, State of Louisiana, met in regular session on the __ day of June 2021, and adopted the following Ordinance regarding the abandonment of a sidewalk in the Original Townsite of DeQuincy.
WHEREAS, the City of DeQuincy has been contacted by Shandel Hambrick, the President of DeQuincy Iron Horse Pub, Inc., regarding the abandonment of the sidewalk on the North side of its business at 401 Lake Charles Avenue in DeQuincy, Louisiana, and after a favorable finding by the City Council that abandonment would be in the best interests of the City and for other good cause shown,
THEREFORE, BE IT ORDAINED by the City Council that the City does hereby abandon the following sidewalk along Lake Charles Avenue previously dedicated to the public within the City limits of the City of DeQuincy, Louisiana, and being in the Original Townsite to the City of DeQuincy, Louisiana, as per plat recorded in the records of Calcasieu Parish, Louisiana, the dedication of the property as revoked, set aside and vacated being more particularly described as follows:
Commencing at the Northwest corner of Lot 12 of Block 16 of Original Townsite of DeQuincy, Calcasieu Parish, Louisiana, thence West to the Eastern right of way line of Pine Street, thence North along the Eastern right of way line of Pine Street to the Southern right of way line of Lake Charles Avenue, thence East along the Southern right of way line of Lake Charles Avenue to a point due North of a point 24 feet East of the point of commencement, thence South to a point 24 feet East of the point of commencement, thence West 24 feet to the point of commencement,
it being the intention of the City of DeQuincy, Louisiana, as owner of said sidewalk to relinquish and quit claim said sidewalk to the owner of the contiguous land, DeQuincy Iron Horse Pub, Inc., with the stipulation that DeQuincy Iron Horse Pub, Inc., its employees, customers, guests and all other persons located on the sidewalks shall not obstruct the sidewalks to the detriment of any person or persons attempting to use said sidewalks for passage through the area.
BE IT FURTHER ORDAINED that by this revocation it is the intention of the City of DeQuincy to cause the property relinquished to revert to the present owner of the land contiguous to the said sidewalk so released and relinquished to hereafter own same as described hereinabove, as directed by law, this quit claim, revocation, abandonment and relinquishment to be however, without warranty of title to the contiguous land owner, in whose favor this relinquishment and abandonment runs.
BE IT FURTHER ORDAINED that the City of DeQuincy reserves unto itself, its successors and assigns, a servitude over and across the above described property for repair and maintenance of any and all utility lines running under said sidewalks with full power and authority to take any and all actions necessary and proper to repair or replace any such lines as needed.
BE IT FURTHER ORDAINED that this Ordinance shall become effective immediately.
This Ordinance was declared duly adopted this 14th day of June, 2021.
