AN ORDINANCE TO ALLOW A RETAIL BUISNESS LOCATED AT 702 WEST FOURTH STREET LOCATED WITHIN THE 300 FOOT DISTANCE FROM A PUBLIC SCHOOL TO ENGAGE IN THE RETAIL SALE OF ALCOHOLIC BEVERAGES
WHEREAS the City of DeQuincy desires to permit a retail business establishment located within 300 feet of a public school to engage in the retail sale of alcoholic beverages as an exception to the provisions of Section 3-28 of Article I of Chapter 3 of the Code of Ordinances of the City of DeQuincy
THEREFORE, BE IT ORDAINED by the City Council of the City of DeQuincy, in legal session convened, that the Owner and/or Lessee of property located at 702 West Fourth Street, DeQuincy, Louisiana, described as follows:
All that certain parcel or tract of land containing 1.803 acres, more or less, land being situated in the Northeast Quarter of the Southwest Quarter (NE/4 of SW/4) of Section 13, Township 7 South, Range 11 West, Southwestern Land District, Louisiana Meridian, Calcasieu Parish Louisiana, and being more particularly described as follows:
Commencing at a found 1 ? inch iron pipe in concrete at the Northeast corner of the Southeast Quarter of the Northwest Quarter (SE/4 of NW/4) of Section 13, Township 7 South, Range 11 West; thence along the center line of said Section 13, run South 01 degrees 05 minutes 13 seconds West (record South) for a distance of 1,385.26 feet (record 1384.8 feet) to a point on said centerline of Section 13: thence leaving said centerline run North 89 degrees 11 minutes 33 seconds West for a distance of 25.03 feet to a set 5/8 inch rebar with cap stamped Collins 4390 at the intersection of the South Right-of-way line of Smith Road and the West Right-of-way line of North Overton Street; thence South 01 degrees 05 minutes 13 seconds West (record South) for a distance of 216.25 feet to a set 5/8 inch rebar with cap stamped Collins 4390 and the Point of Beginning of herein described tract; thence continue South 01 degrees 05 minutes 13 seconds West along said West Right-of-way line of North Overton Street for a distance of 298.61 feet (record 298.64 feet) to a found Louisiana Department of Highways Concrete Monument at the intersection of the North Right-of-way line of said Louisiana State Highway 12 (AKA West 4th Street) and the West line of said North Overton Street; thence North 89 degrees 01 minutes 03 seconds West along said West Right-of-way line of Louisiana State HWY 12 (AKA West 4th St) for a distance of 263.00 feet to a set 5/8 inch rebar with cap stamped Collins 4390; thence leaving said West Right-of-way line run North 01 degrees 05 minutes 13 seconds East (record West) for a distance of 298.61 feet to a set 5/8 inch rebar with cap stamped Collins 4390; thence South 89 degrees 01 minutes 03 seconds East for a distance of 263.00 feet to the Point of Beginning, containing 78,534 Square Feet or 1.803 acres, more or less,shall be allowed to sell closed containers of alcoholic beverages to customers of the business with the stipulation that the containers shall not be opened or consumed on the business premises under any circumstances.
Said Ordinance having been introduced on the 13th day of June, 2022, and considered by the Council on motion by Ronda Jacobs, seconded by Mark Peloquin to adopt the Ordinance, a recorded vote was taken and the following result was had on the 11th day of July, 2022.
